Desde principios del Siglo XX, la prohibición de la cocaína -que tenía uso legales y se vendía en farmacias- trajo consigo el desconocimiento de los efectos reales que la sustancia puede causar en las personas que consumen (entre ellos, afectaciones graves a la salud o la muerte). Esto se debe a las sucesivas adulteraciones que padece la sustancia en una cadena de valor regulada por el mercado ilegal -que prioriza las ganancias por sobre la salud de sus clientes-, lo que expone a las personas a daños potenciales que pueden generar los productos utilizados para estirarla. El desconocimiento de la composición es producto de la prohibición, que expone a las personas a situaciones de inseguridad que pueden tener consecuencias físicas graves o fatales (como la que sucedió en esta ocasión).
Antonio Escohotado nos enseñó que, a principios del siglo pasado, en contextos de venta y consumo legal de cocaína, había cuasi nulos índices de mortalidad por consumo de la sustancia en su estado puro; las personas que la consumían solían conocer y preveer sus efectos, y podían graduar las dosis de forma responsable, adulta y racional. Una vez que la prohibición ganó terreno, las adulteraciones de la calidad de la sustancia -con productos no aptos para el consumo humano y direccionados únicamente a incrementar el volumen- significaron muertes y graves afectaciones en las personas que consumen. En su Historia General de las Drogas, Escohotado da como ejemplo la adulteración de la coca con yeso; esto producía que las personas que aspiraban padecieran un taponamiento inmediato de las arterias y una muerte súbita. De esta manera, las personas no morían por la cocaína, sino por el yeso de venta libre en cualquier pinturería y por la ausencia de un Estado que decidió apartarse de la regulación responsable de esta y otras sustancias (dejando el mercado a las redes ilegales de abastecimiento).
El Estado Argentino incumple la regulación de la Ley Nacional de Salud Mental y la Ley de Abordaje de Consumos Problemáticos, las cuales demandan establecer abordajes de reducción de daños; mediante estas herramientas podrían evitarse algunas de las muertes causadas por la adulteración de drogas. En España, hace por lo menos 25 años que la sociedad civil junto a diversas instituciones públicas desarrolla programas de testeo de las sustancias, con el fin de informar a las personas que consumen -y a la población en general- la calidad de las drogas que circulan y los riesgos de su consumo. Experiencias semejantes podemos localizar en nuestra región; hace años existen experiencias en México, Colombia y Uruguay.
Nuestro país se encuentra muy atrasado en la materia y sus instituciones públicas sostienen un discurso perimido, anacrónico y poco realista, respecto de la abstención en los consumos; mediante campañas inútiles señalan que la solución básicamente es “no consumir”, cuando en la práctica la población consume cada vez más y el mercado de sustancias está cada vez más diversificado. Estos discursos morales no han tenido ningún impacto ni muestran resultados positivos, pero la prohibición sigue siendo redituable en términos económicos, proselitistas y burocráticos.
Pareciera que sólo nos alertamos cuando jóvenes mueren en una fiesta electrónica por el consumo de pastillas de calidad adulterada o cuando suceden hechos como el de hoy. Lo que debería establecerse es una política de Estado clara, basada en la reducción de daños -que alerte a las personas de los efectos reales que causan las sustancias y los adulterantes con las que suelen cortarse– realista, basada en evidencia y alejada de cualquier sensacionalismo paternalista o supersticioso. Ello se podría hacer mediante el Sistema de Alerta Temprana (SAT) de la Organización de los Estados Americanos (OEA) -del cual nuestro país es parte desde 2016-, mecanismo que se encuentra en claro desuso para dicho fin. Debería hacerse así un monitoreo constante de las sustancias que circulan por el mercado y sus adulterantes, a fin de informar a la población sobre sus calidades y efectos posibles. No es ningún invento, sino que es una práctica que se lleva adelante en otros países desde hace décadas y que se encuentra dentro de los abordajes de reducción de daños recomendados por diversos organismos internacionales -como la Organización Mundial de la Salud (OMS)- y exigidos por nuestras leyes nacionales hace por lo menos una década.
Por último, la criminalización y la estigmación significan un grave obstáculo para las personas que consumen porque no acceden a información verídica sobre los efectos reales de las sustancias y sus adulterantes (sean inertes o activos) y porque no tienen la posibilidad de buscar de asistencia -en caso de requerirlo- por el abordaje punitivo y los prejuicios que existen. El contacto de las personas que consumen con el Estado, en un contexto de criminalización como el de nuestro país, suele resumirse en la relación de vulnerabilidad que tienen con las fuerzas de seguridad y el sistema punitivo. La necesidad de un abordaje respetuoso de los derechos humanos, con una mirada basada en principios de salud pública y no represión, requiere el cumplimiento de las leyes existentes y la transformación del ordenamiento jurídico -que incluye la derogación de la vetusta ley 23737- para respetar los derechos de las personas que deciden usar sustancias. Esta es una de las deudas más grandes de la democracia.
